Terms and Conditions for Sitombe Photobooths Photo Booth Services

1. Introduction

These terms and conditions (the "Agreement") govern the use of photo booth services (the "Services") provided by Sitombe PTY LTD ("Company"), registered in, South Africa. By booking and using our Services, you agree to comply with and be bound by this Agreement.

2. Booking and Payment

  • Clients must provide a full payment to secure a booking.

  • Cancellation policy: Clients may cancel the booking 7 days before the event date for a full refund of the total payment.

  • Changes to the booking date are subject to availability and may incur additional charges.

3. Use of Photo Booth

  • The Company will provide a functioning photo booth for the specified duration of the event.

  • Clients are responsible for ensuring a suitable and safe location for the photo booth.

  • The Company reserves the right to discontinue services if clients or attendees behave inappropriately or create a hostile environment.

  • Clients agree to respect copyright laws and not use the photos for commercial purposes without written consent.

4. Photo Booth Images

  • All images produced by the photo booth are owned by the client.

  • The Company may use client images for marketing and promotional purposes unless otherwise agreed in writing.

5. Liability and Insurance

  • The Company will not be liable for any loss, damage, or injury resulting from the use of the photo booth.

  • Clients are responsible for any damage caused to the photo booth or equipment by attendees during the event.

  • Clients are advised to obtain their own event liability insurance.

6. Indemnification

  • Clients agree to indemnify and hold the Company harmless against any claims, damages, liabilities, costs, and expenses arising from the use of the Services.

7. Force Majeure

  • The Company will not be liable for failure to perform its obligations due to circumstances beyond its control, such as acts of God, natural disasters, or labour strikes.

8. Governing Law and Jurisdiction

  • This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of [South Africa].

9. Modifications

  • The Company reserves the right to modify these terms and conditions at any time. Clients will be notified of any changes.

10. Entire Agreement

  • This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, representations, or understandings.

By booking our Services, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
